Assuming real time , there should never be any penalty for quitting a game if another player is out of time. And I'm wondering if tournaments/arena would not benefit from automatically kicking out peoples out of time rather than letting it up to the appreciation of the other players. I'm not at all...

This would only suit a few games. On many games, the actual score does not show who's actually on the path to winning. You would need an individual solution for every game which is just not possible. For ELO-culculation i don't see a better solution than something that's similar to what's been done...
