Why is the two headed dragon card not allowing to get that second legendary?

Do you have 3 legendaries on the board?

Yes, it happened in game between the two of us. Three legendary pieces were on the board, He wanted to take one of the pieces not included in the two headed dragon as an upgraded heroic piece (I think) but it did not work.
