So, if I have to take the reputation, that would imply that I cannot use the upgraded animal action at 5, if I already have 9 reputation, but have not upgraded my cards action card, because in this situation, I can’t take reputation, right?
By the way, if this is an official rule fix/clarification, why did it not make into any official errata or faq from the publisher?

Nope, you can take the action if you play an animal. You are forbidden to do nothing.

You may (not must) because if you don't have Cards upgraded, at some point you cannot increase. So you may, if you can.
