So yes, it's imperfect. It doesn't catch the more motivated cheaters and it restricts people who would like to concede earlier legitimately. Honestly, 50% does not seem like it was carefully thought out to balance all the competing concerns. It just seems arbitrarily chosen as the halfway point between 0 and 100%.
How is this a problem though? The only thing people who "cheat" like this accomplish is that they give themselves a higher ELO than they actually have. Then when they start to actually play games at a higher ELO level they get their ass kicked.
If someone would ever manage to get themselves to the top of the ELO board in this manner it would be like you say very easy to detect automatically that no actual games were played.
