Are the Opting Out rules different for 2 player games? My opponent just opted out and it seems they took 2 black dice as I am now rolling only 3. Usually you only take one dice when you opt out?

Yes, if you check out the rulebook you'll see that for 2 player games:
- you get two starting colors
- 2 dices are removed when opting out.

I usually play this game two-player real time and am always left with 4 dice
