Question on reorganizing your trajectory after crash

In a game yesterday one of my opps didn't realize coming out of turn accelerating would cause an instant crash they way they did it. He reorganized his trajectory, changed lanes at that critical spot, and avoided the crash completely and finished the turn unscathed--no penalties at all.

My question is--if you wipe out in 5th gear, but reorganize the moves in such a way you actually wiped out in 2nd or 3rd gear, do you still get the penalties for a 5th gear crash, or just whatever would have happened to you in 2nd or 3rd? How much can you "fix" by reordering your moves?

Just whatever would have happened to you in 2nd or 3rd gear.
