you're playing a turn-based game, not real-time. the other player still has 10 hours to play. the time appears next to the name of each.

How do I leave without penalty? because the player has not played since...

You can‘t. Just keep going and play 1-2 moves on it per day. You still can play a real time game next to it. If that doesnt work for you, you can ask nicely whether your opponent would accept to abandon the game mutually.
