It's frustrating to be playing a slightly lower ranked player in a game where a tie is possible/likely (such as Break the Code or Lucky Numbers) and losing ranking points from getting a tie (and your opponent gains).

That is consistent with how ELO works. Managing to obtain a tied result against a higher-ranked opponent gives a slight positive ELO adjustement, and conversely being unable to win and having to settle for a tie against a lower-ranked opponent gives a slight negative ELO adjustement. Less than an outright win or loss.
