game license - open source game

I'm wondering about developing a BGA game that is open source - specific example is the game TripleA:

Technically this is not a "published" game, it is modeled after a published game though, so it doesn't exactly fit the normal pattern for BGA.
Would it be possible to do this on BGA? The game "license" is already technically available, but maybe it would make sense to check in with their forum. Any other thoughts?

So I emailed over a month ago and every 2 weeks since, and have not heard any response of any kind. Any suggestions?

Hi - dose anyone has any suggestions for how to get an answer about developing TripleA on BGA. It would be great to get an answer either way, I'd like to get a definitive no if that is the case so I can start developing elsewhere.

Yeah, correspondence is not their strong suit.
Some of them hang out on discord. I was asked to have a private discussion once with an admin there.
