Hypnosis/Pilfering when tied for first

My interpretation of the glossary:

"If there are several zoos with the highest appeal, you may choose which player is affected. If you are the affected player, the ability has no effect."

...is that if you are tied for first on the appeal track, that you can decide that the other tied player is the affected player, and attack them. BGA implementation disagrees and won't let you attack if tied for first. Am I missing another rule or clarification?

Naturally, I know constriction/venom are phrased differently, that opponents must be *ahead* to be attacked.

This is not a place to report bugs, read the red lettering on top.

You also need to provide replay, it is possible that both of you were under 5 appeal, or that the opponent had the card that protects from hypnosis/pilfering.
