Concern about the Arena Mode unfinished turn-based games

The rule clearly states:
If your turn-based game is not finished at the end of the Season, the player who spent the most thinking time during the game will lose the game and lose Arena points.
I think that this is not a good approach nor it is fair.
Please correct me if I am wrong.
If a game is at 99%, so its almost finished and the arena season ends. The leading player that should have won would lose the game (and points) because he spent the most time thinking. It happened to me both previous and this season. I dont think it is fair.
I repeat, this is a turn-based game where we play when our private obligations allows. Some playes probably have more free time, others, such as myself, have family and jobs, and limited timeframe for fun.
There should be no punishment for most time thinking because it defeats the purpose of turn-based gaming.
I know that, from certain point of view, that players can behave in an improper manner and spend a lot of time to force game ending in order not to lose the game, so I assume that this is the reason for this rule. But if that is the case, maybe it could be isolated to a last move/moves.
Still, I think that the player with most points earned at that point should still win the game.
