Asmodee has released the new rule some time ago, with a new Terrain Height rule. This rule has been in use in different tournaments already, but is not yet implemented on BGA. I've made a bug report to request this rule update, so please vote for it if you agree:

Isn't it already implemented? I remember being surprised by a tank shooting from one hill at my troops on a non-connected hill without any attack-die penalty.

That's the normal rule. Even in the original game, the hill dice reduction only applies if the attacking unit is downhill.
The new rule is about the line of sight and the fact that terrains and units at height 0 do not block the line of sight, and if I'm not mistaken, that hills do not block the line of sight at all when shooting from a hill to a hill (previously, if the unit were on different groups of hills, the hills between them would block).

Exactly, you can also look at the PDF link in the bug report that shows the new rules.
