Oh but my observation goes beyond BGA. Even in real life there are lucky and unlucky times for me when i play at the table with my friends. As if it was random somehow.

But I think overall it is still the better solution because after all when that happens it's still the one being kicked who definitely did something wrong (used up too much time) and also they had the chance to speed up to get back into positive clock and not be available for being skipped anymore....

I don't see the problem. If they decide not to kick out, it means they've considered the possibility you describe and are fine it.
