Azul laying tiles question

Hi..
at the picture you see an azul board with the grey background.

The top 2 rows can only be filled with red on top of each other, which would be illegal, right? How is this possible?

I think the later row (whichever that was) should have put in the row whith negative points. Am I wrong?

If I understand the rules correctly, your image is perfectly acceptable by the rules. You can place red both in row 1 and row 2 during the "Factory phase".

However, when the "Wall-Tiling phase" will begin, the player will move his 1 red stone to row 1 and complete it (for 5 points and 2 bonus points later). Then he will move his 2 red stones to the floor line (for -4 points) because there is no valid space left for red in row 2.

Thus the 2 red stones of row 2 will be discarded in a later stage which is not shown in your screenshot.
