Why is the pilfer option sometimes greyed out even though the opponent has more appeal?

Why is the pilfer option sometimes greyed out even though the opponent has more appeal?

Is it a bug? I've had it happen a few times now when playing the capuchin. Opponent has more appeal, I play the capuchin, I want to take the pilfer action before getting the appeal, but I can't.

Because the opponent's appeal is within 5. You cannot do anything to the opponent when his/her appeal is within 5.

Ok. I guess that's something from the rulebook, cause there's no mention of it on the cards. Thanks for the clarification.

Yup, also there is a tiny sign on appeal track at 5, reminding you that you can now be targeted. However, on digital version, you have to open it to see it whereas you have it in "plain sight" with a physical board
