This is the published rule. BGA follows the published rules unless specifically given permission to do otherwise by the rights holder for the game. BGA didn't just make it up out of thin air. If you want to write to the game publisher to ask them to change the published rule or give BGA permission to implement a tie breaker that differs from the published rule, you are free to do so.

I agree! There must be a better way. Even if it's a draw, and no players win or lose points.

Even if it's a draw, the higher-ranked player loses points and the lower-ranked player wins points. That's how elo works, and that's fair.
