We agreed to end the game but someone got penalties

Tonight there has been many connection difficulties. One of our partners seemingly had troubles (exceeded alloted time), and we decided commonly to end te game so that the partner in difficulty does not get penalties.

He/she got penalties despite this.

Is this normal ?
