Leaving Games from When Website was Glitching

I am currently stuck in a real time game that froze/crashed a few hours ago when the website was having major issues. My opponent is offline and I have no idea when they'll be back online. I don't want to kick them out (giving them an unwarranted penalty when they didn't do that to me despite it crashing during my turn) and I don't want to quit (giving myself an unwarranted penalty) either. We are not far along enough in the game for me to concede, or I'd just do that and take the hit to my ELO. Do I have any immediate options? I'd like to play other games now that things seem to be back up and running and I can't do that with another real time game active.

Even worse, I'm in a game that won't even let me quit, let alone concede or kick anyone else off. What fun.

unfortunately, things do not appear to be up and running.

If you expel your opponent (And at the moment, I cannot perform any game actions), your opponent will receive no penalty. Penalties are nullified during such outages.

I would suggest just leaving the game be, but if it's real time and you would end up forfeiting later while sleeping or something, you only have one option. Or maybe you can propose to abandon, which would automatically be accepted if your opponent is out of time.

You could switch it to turn based, perhaps?

I think abandons don't require the consent of out of time players, so hopefully would work here? I can't recall trying it myself though. It could also possibly be switched to turn-based timing, which would stop it blocking new RT games. But depends if OP wants to play it out at TB timing, although you could offer an abandon there (assuming the abandon you offer now does require the other player's consent).

I proposed switching to turn based (my opponent has been offline for a while). I gave up and tried both quitting and ejecting the other player and neither of those worked either... at this rate I'm assuming I'll just have to give up for today and see if things are fixed for tomorrow. Thanks for the replies though.

I just (finally) was able to get out of my game. Hope you are able to do the same now :)

That is correct. I've done it before when people have timed out right at the start of a game.
