I did suggest that as one interpretation of your post. That's not all that different to jury duty - which, while I know that's an important civic duty, people generally hate doing it. I can't see most people signing up for it for something like deciding kingmaking, and forcing people to do it isn't going to end well either. We're talking about matters outside the moderator's jurisdiction. Of course, it would be better if the moderator addressed the kingmaker problems.
Kingmaking is mostly best dealt with by red thumb. It means you won't play them again (outside tournaments), and if they really are kingmaking, eventually enough people will red thumb that it may be hard to get games. That's the theory anyway, but again, depends on your player pool size.
