Activating common Action card

Before I post in the bugs forum, I want to make sure I'm not missing anything. Why would I (the Japanese player) not be able to use Settlers at this point? https://boardgamearena.com/14/imperials ... =801683686 (move #371)

it did work its highllighted, but you just did it one turn later
