Starving during final combat?

Several times I have starved (lost health due to not having food) mid-combat with the final boss. I was wondering if the "delving" phase is maybe happening when the boss transitions to phase two? Is this supposed to happen or is it a glitch? I don't see anything in the rulebook to explain why this would happen.

On the last section of the last floor with the final boss, I don't bother getting any more food, since you don't need it. So I often go into the final boss with 0 food. I have never lost health points due to not having any food left.
I played with the expansion but I have the overlord and combat stance disabled. So it's a glitch or you are playing with an option that makes it a rule.
