Response to Illegal Moderation

Post by Ze Monstah »

In response to the Administrator who "handled" my Illegal Moderation post:

There was nothing fake in my post (I copy-pasted the chat transcript), and I think the fact you deleted the chat in the game I mentioned... is proof enough for me and everyone, about the "fairness" of the moderation job, in this case; I think you simply didn't want any more players to see the unfair moderation, you didn't want to admit the moderation was wrong, and used the 10% Limit of Red Thumbs exceeded and the 2 previous Moderations (1 and 3 days) as cover-ups for your lack of professional moderating.
I rewrote the chat below, with no usernames given, and I am sorry if writing the username and the link of the game, was the reason you deleted my text.

If a player feels (s)he has reasonable complaints, (s)he should be free to talk about them and receive feedback... Without being threatened or worried (s)he might get banned (for no reason in this particular case).

You put the problem like this: if a player leaves games, has a ratio of Red Thumbs >10% or has been reported before, (s)he cannot talk if something wrong is happening in a game, because if (s)he gets reported, the moderation team will ban him/her by default, regardless of who is the culprit. I am pretty sure this is not ok for a "nice site", as you call it.

It is as if I don't respond to a "Good Game", and the player reports me for... "silence", the moderator moderates me for... "silence", and because of the previous moderations; and if I complain about it, you will dismiss my complaints and give the "previous moderations", "leaving games" or any other thing for which I was already punished, as reasons.

"There is stats. And words. We have them. All. Want to show them ?"
By all means, yeah! Show me. If I throw an ironic "nice job", "good play" or "really smart what you did", or use the F word rhetorically, or say a rhetorical "s****d luck" about my luck, those things can be self-educated, I assure you. I am sorry if I offended someone (in)directly, in the heat of a game.

"Don't take the forum as a place to make your own justice : We can see which statements are false and/or justified."
How am I supposed to make justice for myself in this case, if I feel the moderation for the text underneath is not respecting the LEGAL and MODERATION POLICY pages you wrote?
If you want to ban me from the site because I defend and criticise your moderation, with valid arguments and examples (IMO), it is not ok, but go ahead... this is the last month I pay for a Premium account, anyway.

Here it is again... Still you didn't explain to me why I was moderated for the text beneath, according to your Legal and Moderation Policy pages. And since no one in the BGA team talked to me directly about the text written below... (https://boardgamearena.com/legal, http://en.doc.boardgamearena.com/Moderationpolicy).

I understood all you wrote in that late response on the Illegal Moderation post, I DO NOT AGREE WITH IT, and this is the last time I address this issue.

Good luck in all, BGA.

Wow. The thread got locked?

Yet another proof of the abysmal BGA communication practice and overall poor BGA treatment of customers, premium or not.

Oh, by the way, I still cannot access even my basic account (incl. management of premium subscription or other details).

Can we also talk about the actual tone of the messages from Dr.Click, the words used and the (empty) threats made in the closed thread.

Ridiculous.

One more thing: feel free to publish it all. I'll be happy to publish emails received by unidentified person(s) writing from a BGA account. Sure had a striking similarity to the tone and words by Dr.Click, but who knows.

What I do know it is documented and REAL WORLD proof of being in conflict with basic EU customer and privacy laws. Let's go toe to toe.
One side publishes IN GAME data, like disconnecting from games because of play on a mobile device in spotty network or travel conditions.
While the other publishes real world breaches of a company breaking actual laws.

Your move, BGA

Cheers

Additionally let me file a request to receive all of my data collected on this website in entirety.
This as stipulated by EU regulations under GDPR and other relevant rules, laws and every thing.
The beauty of those is that as a customer I do not actually have to state more than this or refer to any specific rule or law (this is actually clearly stated in GDPR itself).

You have 30 days from this request onwards to reply in full, as per GDPR regulations. Feel free to use my e-mail on file to respond, I look forward to it.

To give you a bit of a starting point of what aspects you will have to cover (an absolutely not exhaustive list, just something to get the ball rolling): I am also very keen to hear how all of my data is collected, stored, what members of your organization has access to it and what possible interactions exist based on my basic account data, data points collected from any activity on this website, including - but not limited to - how a (to this point unidentified) person might want to ask for any part of my PII data set registered on your website via unauthenticated and/or unverified e-mail.

Thank you very much for your response.

"in the heat of a game."

There should not be a "heat" associated with a game here.

The fact that the last thread "Illegal Moderation" was locked is complete and utter fascism.

BGA mods are clearly little dictators that shut down free speech. This site is becoming like a microcosm of the death of democratic nations in our world today.

I think that just like the BGA team, you use other things to make the idea I complain about (the bigger picture - the unfair moderation) seem less critic-worthy.

The idea in my post is about that specific moderation, for which I considered I was unfairly banned for 3 days. The other things written, are used in the contexts brought by the Administrator who shut down my first post.

If I was told that the "first thing would be to think about what I've done to come to this", I strongly think that BGA should also think what triggered this huge amount of recent critics from many (former) BGA users, regarding the BGA moderation and leadership, considering this is such a nice user-friendly place and all.

Have the best of days.

I don't know... I considered he did it because I included a link of the game and most importantly, the name of the player involved. But I rewrote the text, not including anything. So I am curious if this post will be shut down, too, or even more, if I will be banned from this "nice" community because I dare to critic its leadership.

Cheers. :)

I think at this stage, based on actual evidence - not based on whatever happened at a game table, ffs - but actual communication between customers and a service, it is fair to come to a conclusion that approximates the wording used by Ryusan. This is 2020, things like shutting down a thread or making blanket statements in some hidden disclaimer or /legal page does not work or suffice. We have a moral code (in the real world) and actual regulations and laws. This broken version of moderation in BGA is a rather dysfunctional attempt of implementing the former in a game world due to the fact that it is clearly governed by (unknown) individuals who neither consistently nor cohesively demonstrate anything close to acceptable behaviour. All aggravated by the antics displayed in their email and forum response, which again is not a game table. Do you understand the difference, BGA?

Simply put: I think BGA has lost the plot in terms of absolute as well as relative treatment of valid customer concerns complaints about their site vs. whatever silly events on a game table that might have lead to moderation. Get a grip, breathe and hire 1-2 actual professionals for both Customer Care / Service AND Legal/Compliance work (or more, depending how long you plan to take for my pending GDPR request, have not seen a reply yet!). Now that I think of it, I also haven't heard back on my other request via e-mail. So yeah, probably hire more people to help with that too.

I think it has been proven with overabundance that the current approach BGA is using is not working.

BGA is a "community-based website", not a democratic government. There has been no right to free speech to begin with.

I think Ryusan used an euphemism to state his opinion.
And by "free speech", I think he meant users (premium or not) not being able to express opinions towards something which looks like an injustice, or if they do, the issue not being solved or talked over by the BGA team (with arguments, and not with ignorance, threats or silence treatment).
