I have been experiencing quite a few games with a server error in the last 2 or 3 months. I am probably not the only one. I would like to encourage you to make bug reports or support the existing onces so that this problem is hopefully resolved sometime soon.

Yes he can play the game as non-premium.
As non-premium you can't start a table on a premium game. You can join an existing one.
